Durante la larga vida del escritor y pensador Miguel de Unamuno, hubo dos labores que nunca dejó delado: su trabajo como educador y su vida de escritor. Ambas partes fundamentales de su pensamiento ya que las entiende como centrales para comprender el misterio de la particularidad existencial del hombre de carne y hueso. El presente trabajo tiene como objetivo el análisis a profundidad de dos temas principales: la labor de la educación y el trabajo de escritura en el pensamiento del (...) pensador vasco. Para este análisis se investigó a profundidad la obra escritural del vasco universal, tomando en cuenta que el grueso de sus ideas entorno a la educación y a la escritura se encuentran contenidas tanto en su obra poética como en su correspondencia. Así mismo, se utilizaron trabajos periféricos de autores especialistas en Unamuno y su pensamiento para complementar las ideas. Mediante la investigación, fue posible mapear las ideas del pensador vasco para llegar a una de las ideas centrales de su pensamiento: Tanto el educador como el escritor tan solo pueden ensañar lo que ellos mismos son, es por ello por lo que su labor no es otra que la de poetizar la vida, abriéndose paso a través del lenguaje, narrándose a uno mismo y ayudando a otros a encontrar su voz. The purpose of the present paper is to unveil whether the power distance/textual complexity duality attributed ordinarily to legal language applies to two different documents which are widely deployed, interpreted and applied in the global scope of commercial trade and communications, namely Lloyd’s Institute Cargo Clauses and the London International Court of Arbitration Rules. In choosing two texts which are the direct product of the law-making machinery of the Common law system, but which are used internationally, we ultimately undertake to (...) research whether opacity is really inherent to legal texts in English with an international scope of implementation. To scrutinise, illustrate and argue on the degree of difficulty and power distance in such legal instruments, the perspective of genre has been chosen as the most effective of instruments provided by current Applied Linguistics. Genre analysis permits to identify the genre or genres of a specialised professional community connected to the communicative group it comes from, the audience that receives it, the historical and cultural background and the extra-textual reality it aims to represent. The goal of our study, carried out through different levels: formal, discursive and, mainly, pragmatic, is to discern whether there exists any possible equation between power and textual complexity, and the consequences this entails for the understanding of the nature of these major international texts. The present work examines the role of persuasive lexicon in legal discourse through the analysis of emotional devices at a lexical and rhetorical level. Our preliminary premise is that emotion is deployed by experts to convey the sentiment of shared values and epistemic trust: the need to rely on the tenets of the law as fair and conducive to the common good. The corpus of our study is constituted by the conclusions in their original Spanish, and their translation into English, (...) by the Advocate General Manuel Campos on the challenge by Hungary and Poland of the regulation establishing a “conditionality regime” in the event of a rule-of-law breach in a EU Member State. To this end, we undertake a two-pronged analysis of legal persuasion to find out what emotional devices are deployed to convey the rule-of-law principles of justice, non-discrimination, equality and solidarity. At a first stage, we concentrate upon the polarity and intensity of emotion words and their categories. Emotional implicatures in the shape of legal technolects and metaphorical ontologies and the way they are deployed in each text constitutes the second part of our study. Among our conclusions are that both the original and target texts have a strong persuasive character, mainly grounded in the negative emotion of fear and the positive emotion of trust, and that there are variances in the emotional language deployed in either version due to the different mechanics of each law system and to functional differences between English and Spanish. Focusing on media discourse and adopting a Critical Discourse Analysis—linguistic and rhetorical—perspective, this paper explores the role of the media in influencing citizens’ behaviour towards the COVID-19 crisis. The paper evaluates the set of potentially persuasive lexical items and emotional implicatures used by two quality newspapers, i.e. The Guardian and El País, to report on the pandemic during the three waves—the periods between the onset and trough of virus contamination—that occurred until March 2021. A representative, ad-hoc, comparable corpus was compiled (...) in English and Spanish comprising the news on the pandemic that appeared in the aforementioned newspapers during the three established time periods. The corpora were uploaded to Sketch Engine, which was used to first detect and analyse different categories of word frequency, and then assign negative or positive polarity. Lexical keyness was secondly analysed to categorize emotional implicatures of control, metaphors, signals of epistemic asymmetry and positive implicatures in order to discern how they become weapons of negative or positive persuasion. The ultimate end of the study was to critically analyse and contrast the lexicon and rhetoric used by these two newspapers during this time period so as to unveil the stance taken by governments and health institutions—voices of authority—to disseminate words of control and persuasion with the aim of exerting influence on the behaviour of citizens in UK and Spain. According to the broaden-and-build theory of positive emotions, the frequency of positive emotions is associated with the development of positive attitudes, cognitions, and behaviors in organizational contexts. However, positive and negative attitudes at work might also be influenced by different personal and job resources. While emotional intelligence has been significantly associated with positive job attitudes and personal well-being, no studies have yet examined the joint role of teacher happiness and emotional intelligence in key teacher job attitudes. The present study assesses (...) whether emotional intelligence interacts with levels of teacher happiness to jointly explain important teacher job attitudes. A total sample of 685 teaching professionals filled out a battery of scales including subjective happiness, emotional intelligence, job satisfaction, and turnover intention. Our results revealed that subjective happiness was significantly associated with both higher job satisfaction and lower turnover intention. Likewise, emotional intelligence was positively related to happiness and job satisfaction, and negatively related to turnover intention. Finally, interaction analysis showed the main effects of happiness and emotional intelligence in explaining teacher job attitudes. Beyond the main effects, the interaction effects of happiness and emotional intelligence were significant in predicting all teachers' job attitude indicators, even controlling for the effects of their sociodemographic variables. This work expands our knowledge about the role of teachers' positive emotions in the development of positive work attitudes, and also supports the inclusion of emotional skills in future teacher preparation programs as resources to facilitate work-related well-being. En este artículo se explica en qué consisten las éticas centradas en el sufrimiento, presenta algunas de las principales razones a su favor y expone cuáles son sus implicaciones con respecto a la consideración moral de los animales. Se argumenta que conforme a estas éticas los usos como recursos de los animales lesivos para estos deberán ser rechazados. A continuación, se examinan las posiciones que aceptan el uso de los animales siempre que este tenga lugar reduciendo los daños infligidos a (...) estos. Se presentarán una serie de razones por las que tales posiciones resultan cuestionables y por las que van a entrar en conflicto con las implicaciones de las éticas centradas en el sufrimiento. The present research study carries out a contrastive analysis between two corpora of legal opinion columns as special types of genres, with a view to assess their opposing patterns of impersonality—authorial detachment—and attitude—emotion, judgment, appreciation, taking as a point of departure appraisal theory, or the interpretation of Halliday's Systemic-Functional Linguistics by the so-called Sydney School. The long-established perspective is that legal genres are highly impersonal; authoritative instruments representing an intentional exercise of elitist and exclusionary practices. However, the hypothesis embedded in (...) the present study is that some texts, such as news editorials and op-eds, constitute hybrid genres where the writer makes use of all kinds of inducement devices to support his/her theses with effectiveness and credibility, nonetheless retaining one of the basic traits of monogloss legal discourse: impersonality. However, it is hypothesized that this hybridity is to take place in different degrees, in tune with the influence exerted by legal system that constitutes the background of each corpus. To prove such a point, 40 legal op-eds—roughly, a thirty-five-thousand-word corpus in English and Spanish overall—were scrutinized, having been extracted from the specialized legal sections of two national newspapers of undisputed prestige as opinion-formation media. Through a contrastive study, the purpose of the present work was set to describe, explain and assess how lexicogrammar devices unveil interesting differences between the expression of impersonality and attitude in legal opinion columns as genres in either language, hence reflecting different ways in which the law is envisioned in each of the particular legal systems they belong to. Una de las pasiones humanas más fuertes es la tendencia natural a buscar la verdad, inclinación que puede expresarse como relación intencional originaria de la persona con la realidad en toda su amplitud, sin poner límites extrínsecos al saber en sí. Siendo el conocimiento científico una concreción particular de esta aspiración nativa a buscar la verdad total mantiene, a quien lo practica movido por esa pasión, abierto, casi incitado, a continuar la búsqueda sin establecer a priori límites a su natural (...) desembocadura. Está, por tanto, en sintonía con el imput que ha dado vida al quehacer científico que el investigador se deje mover por el mensaje que le presentan los datos y resultados de su trabajo, sin cerrarse a ulteriores investigaciones, pensando que la ciencia es la única forma de saber. La actividad científica se muestra entonces capaz de conducir al hombre hacia los fundamentos de la realidad natural, y de acompañarle en su apertura a la trascendencia. Separada de la filosofía en el plano vital, declarada autosuficiente, la ciencia ha sido un factor de deshumanización. A su vez, la filosofía, distanciándose de los saberes científicos, rehusando entrar en diálogo con ellos, ha perdido vitalidad. El trabajo de Niels Stensen, científico danés del siglo XVII, pionero en algunos ámbitos del saber experimental, ofrece un ejemplo paradigmático de un hacer científico en relación vital con la filosofía y con la fe, sin menoscabo de las legítimas exigencias de autonomía metodológica. Este trabajo plantea el vínculo entre el cambio climático y la movilidad humana desde la perspectiva de la protección internacional. Para ello puede hablarse tanto de desplazados como de refugiados climáticos. Mientras se consolida la idea de amparar a las personas desplazadas en el contexto de desastres y cambio climático, persiste la discusión acerca de los refugiados medioambientales. Desde este estudio se evidencia la urgencia de articular un estatuto de refugiado climático a partir de la revisión de la Convención de (...) Ginebra de 1951. Para realizar una aproximación a la configuración jurídica de la noción de refugiado climático, se analiza de modo crítico las iniciativas existentes y la aportación del Comité de Derechos Humanos. Se evidencia así que la degradación ambiental puede comprometer, entre otros, el disfrute efectivo del derecho a la vida y dar lugar a la necesidad de protección internacional. (shrink)

There is currently much debate in the economic literature about whether ethical investment involves a financial sacrifice or premium. One of the most common methods of testing this compares the financial performance of ethical investment funds with that of other funds not considered “socially responsible” or ethical. The majority of these research studies evaluate the performance of the ethical funds according to classic measures, whereby different financial markets, in different countries and for different periods of time serve as reference for (...) evaluation. The ultimate conclusion of all of these studies is that there are no significant differences between the performance results of one type of funds and the other. In Spain, ethical investment funds are still an incipient sector of investment. To date, the Spanish market has not been included in any type of analysis of these characteristics. Therefore the main objective of this article is to compare the financial performance of ethical investment funds to that of other funds in the Spanish retail market. We propose the aggregate type of analysis as the Spanish ethical investment funds have experienced a weaker development in comparison to those of other developed countries. In the first step we suggest the financial performance to be compared by style analysis since the asset distribution of the Spanish Social Return Investment (SRI) funds differs from the European trend. In particular, we use the multifactor regression model with style benchmarks. We found that their financial performance is in all cases superior or similar to that achieved by the rest of the funds. In the second step, to achieve a more robust and homogeneous comparison, we used the bootstrap method, comparing ethical and non-ethical fund subsamples by homogeneous groups. No significant differences between these two types of funds have been found. Thus, if we assume the positive o neutral effect of ethical investment on investor utility in the retail Spanish market the financial and social performance (FSP) of ethical funds will be, in aggregate, superior to the FSP achieved by conventional funds. In conclusion, the financial performance of ethical mutual funds in Spain is no sacrifice. (shrink)

Intellectual disability leads to a loss of autonomy and a high level of dependence, requiring support from another person permanently. Therefore, it is necessary to incorporate the assessment of caregiver burden in healthcare actions, to avoid putting the health of caregivers and patients at risk. In this sense, the study aimed to analyze the internal structure of the Zarit Burden Interview (ZBI) in a sample of caregivers of people with intellectual disabilities, to provide convergent and discriminant evidence with a measure (...) of the risk of maltreatment, and to estimate the reliability of the scores from the Classical Test Theory and the Rasch Measurement Theory. The study was instrumental. The sample consisted of 287 Peruvian informal primary caregivers of persons diagnosed with intellectual disabilities. To collect validity evidence, the internal structure (confirmatory factor analysis, CFA) and the relationship with other variables (convergent and discriminant evidence) were used, while reliability was estimated through the omega coefficient and Rasch analysis. The internal structure of the ZBI corroborated a unidimensional structure. In terms of convergent and discriminant evidence, the scale presents adequate evidence. Reliability levels were also good. Previously, the psychometric properties of the ZBI have not been studied in caregivers of people with intellectual disabilities, and it represents the first study of the scale in Peru. The results obtained will allow the use of this scale to design actions in the work with caregivers and studies to understand the psychology of the caregiver. (shrink)

Past studies have reported emotional intelligence as a relevant factor in development and maintenance of eating disorders, as well as in increasing self-esteem and reducing anxiety. Similarly, research has showed that anxiety and self-esteem are positively and negatively associated to ED criteria, respectively. However, no prior studies have yet tested the multiple intervening roles of both self-esteem and anxiety as potential mediators of the association between EI and ED symptomatology. The present study aims to bridge these gaps by testing a (...) sequential path model. Specifically, we examine the potential sequential mediation effects of self-esteem-anxiety on the link between EI and ED. A sample composed of 516 Spanish undergraduate students and community adults completed measures of EI, self-esteem, anxiety, and ED symptomatology. The results show that high levels of EI were positively associated with self-esteem and negatively associated with anxiety and ED symptoms. Anxiety was positively associated to ED symptoms, while self-esteem levels were negatively linked to ED symptoms. Moreover, path analyses showed that self-esteem and anxiety fully mediated the relationship between EI and ED symptoms in sequence. These findings suggest that EI plays a key role in reducing symptomatology of ED through increased self-esteem and reduced anxiety symptoms, providing novel evidence regarding psychological mechanisms through which EI contributes to a reduction of ED symptomatology. Implications for assessing and improving these psychological resources in ED preventive programs are discussed. (shrink)

La afirmación de que las reglas jurídicas son derrotables significa que, de acuerdo con nuestras prácticas jurídicas, puede estar justificado que los jueces dejen de lado las normas aplicables en la resolución de disputas y tengan en cuenta en su lugar otras consideraciones. En línea con este enfoque, este trabajo busca esclarecer los tipos de casos y las condiciones en las que, de acuerdo con nuestras convenciones asentadas, es aceptable que los jueces se desvíen de lo establecido en las reglas (...) jurídicas. En concreto, en el artículo se diferencian tres tipos distintos de derrotabilidad: D1 ; D2, y D3. Finalmente el artículo aborda la cuestión de si podemos considerar como jurídicas las consideraciones alternativas a las que los jueces deben apelar cuando estiman que deben dejar de lado las reglas prima facie aplicables. El trabajo concluye apuntando que la clave para trazar los límites entre el Derecho dúctil y el Derecho arbitrario descansa en una respuesta afirmativa a esta última pregunta. (shrink)

El objetivo de esta investigación, desarrollada en el contexto de educación virtual, fue mejorar las competencias investigativas de estudiantes universitarios. Este estudio cualitativo y de diseño investigación-acción se basó en un diagnóstico inicial con el que se identificó plagio académico, además de una autopercepción de nivel medio o bajo respecto de las habilidades investigativas de los alumnos. Durante la ejecución de las estrategias diseñadas, se aplicaron las técnicas de focus group y análisis documental de los ensayos estudiantiles. This paper aims at clarifying some of the most common issues that legal translators have to face when dealing with the translation of private normative texts, such as contracts or wills, which naturally emerge as the consequence and expression of legal or juristic acts in the scope of private law, in Spanish and English. To comprehend the differences and subtleties regarding legal communication between the common law and the continental law countries (specifically the United States and Spain, respectively), we must (...) unveil some essential clues for their translation and application in the global scope of professional interactions, thus creating a process of inter-legal communication, which takes place through the mutual interpretation and application of two, or more, legal traditions. Through the deployment of a generic or pragmatic analysis at textual or discursive and formal or superficial, strata, of two types of genre within the domain of private law (namely wills and tenancy agreements, or leases) this work aims to prove that both the civil law and the common law private instruments are translatable with respect to each other. An important proviso, however, is that their legal traditions and the genres that constitute the communicative tools of their specialised communities must be duly respected and kept in equilibrium, so that one does not overshadow and obliterate the other. Only in that way can the “convergence” of the two traditions truly enrich and strengthen national and international legal culture. (shrink)

Sabemos que desde una perspectiva científica, al activar determinados estímulos musicales se produce una activación a nivel cerebral. Con las agrupaciones musicales escolares se requiere previamente activar las técnicas de audición e interpretación de forma individual para lograr en el grupo, aptitudes motoras, perceptivas, cognitivas y activar procesos afectivos y de socialización. De esta forma, la atención a la diversidad no quedaría excluida. La música, en definitiva, favorece el desarrollo de la persona en todas sus dimensiones, lo cual redunda en (...) una mejora de la calidad de vida y es un gran avance a nivel personal, familiar, escolar, clínico y social. Este estudio trata de dar respuesta a la dificultad que presenta el alumnado que cursa el Grado de Maestro en Educación Infantil para elaborar el Trabajo Final de Grado (TFG). Para ello, se describe una experiencia de coaching con la finalidad de introducir al profesorado de educación superior en dicha metodología como herramienta para la innovación y la mejora educativa en el marco de la tutoría de TFG del citado grado. Finalmente, se discuten los aspectos positivos y a mejorar de (...) la implementación descrita y se plantea la necesidad de fomentar este tipo de metodologías entre el el profesorado de educación superior. In the remainder of this article, we will disarm an important motivation for epistemic contextualism and interest-relative invariantism. We will accomplish this by presenting a stringent test of whether there is a stakes effect on ordinary knowledge ascription. Having shown that, even on a stringent way of testing, stakes fail to impact ordinary knowledge ascription, we will conclude that we should take another look at classical invariantism. Here is how we will proceed. Section 1 lays out some limitations of previous (...) research on stakes. Section 2 presents our study and concludes that there is little evidence for a substantial stakes effect. Section 3 responds to objections. The conclusion clears the way for classical invariantism.
